INHERENT ACCEPTANCE OF OUR TERMS AND CONDITIONS

By using Come2Holiday.com, submitting a Booking, or making a payment, the Guest or Customer confirms that they have read, understood, and accepted these Terms and Conditions.

A Booking may also be subject to additional conditions provided by the relevant Supplier, including house rules, baggage conditions, check-in requirements, age restrictions, cancellation policies, occupancy restrictions, and service-specific terms.

Where specific conditions are provided for a particular Booking, those conditions form part of the agreement and apply together with these Terms and Conditions.

SECTION A: General Terms and Conditions

1. Agreement and Role of Come2Holiday
Come2Holiday provides an online travel platform through which Guests and Customers can search for, book, and pay for Accommodations, flights, and other Travel Services.

Accommodations, flights, and Travel Services are delivered by independent Suppliers.

Unless expressly stated otherwise, Come2Holiday does not own, manage, operate, clean, maintain, or control the Accommodations displayed on its website.

Come2Holiday facilitates the booking, payment, communication, and travel-support process between the Guest or Customer and the relevant Supplier.

The person making the Booking must be legally capable of entering into an agreement and must meet any minimum-age requirement stated for the selected Accommodation or Travel Service.

The person making the Booking accepts responsibility for all members of the travel party.

2. Booking and Payment
A Booking is confirmed once the required payment has been successfully received and a Booking Confirmation has been issued.

Payments are made through Come2Holiday.com using the payment methods offered during the booking process.

Depending on the Booking, payment may be required:

  • in full at the time of booking; or
  • according to a Payment Schedule.

The Guest or Customer is responsible for ensuring that all payments are made by the applicable due dates.

Failure to complete a required payment may result in cancellation of the Booking.

Come2Holiday may request additional information to verify the identity of the person making the Booking or the authorization of the payment method used.

3. Pricing and Availability
Prices and availability displayed on Come2Holiday.com are based on information received from Suppliers and connected booking systems.

The Total Amount payable will be displayed or communicated before payment.

Prices may include accommodation charges, flight costs, taxes, service fees, cleaning fees, supplier fees, platform fees, and other applicable charges.

Availability and pricing are not guaranteed until a Booking Confirmation has been issued.

In the event of an obvious pricing, availability, or technical error, Come2Holiday may correct the error and offer the Guest or Customer the choice to accept the corrected Booking or receive a refund of amounts paid for the affected Booking.

4. Accommodation Information
Accommodation descriptions, photographs, amenities, house rules, availability, and other property information are provided by the relevant Accommodation Provider.

Come2Holiday expects Accommodation Providers to supply accurate and current information but cannot guarantee that every listing will always be completely free from errors, omissions, or minor differences.

Guests should contact Come2Holiday before booking if a particular amenity, accessibility requirement, room configuration, location feature, or facility is essential to their stay.

5. Guest Responsibilities
The Guest must:

  • provide complete and accurate personal and travel information;
  • provide the correct number of occupants;
  • comply with the Accommodation Provider’s house rules;
  • respect the stated maximum occupancy;
  • avoid causing damage, excessive noise, nuisance, or disturbance;
  • comply with all applicable laws;
  • follow the check-in and check-out instructions; and
  • take reasonable care of the Accommodation and its contents.

The Guest is responsible for the conduct of all members of the travel party and any permitted visitors.

A serious violation of house rules may result in removal from the Accommodation, cancellation of the stay, additional charges, or loss of any applicable security deposit.

6. Check-In and Check-Out
Check-in and check-out times and procedures vary by Accommodation.

The applicable instructions will be displayed in the listing, included in the Booking Confirmation, or communicated before arrival.

Guests may be required to:

  • present valid identification;
  • complete an online registration;
  • sign an Accommodation Provider’s rental agreement;
  • provide a security deposit or card authorization;
  • collect keys; or
  • follow self-check-in instructions.

Early check-in and late check-out are subject to availability and may result in additional charges.

7. Security Deposits and Damage
Some Accommodations may require a security deposit, damage authorization, or damage waiver.

The applicable conditions will be communicated before arrival or included in the Accommodation Provider’s terms.

The Guest may be charged for:

  • damage to the Accommodation;
  • missing items;
  • excessive cleaning;
  • unauthorized occupants;
  • smoking;
  • unauthorized pets;
  • lost keys;
  • late check-out; or
  • other violations of the applicable house rules.

The Accommodation Provider is responsible for assessing property damage and determining any applicable deductions.

Come2Holiday may assist with communication between the Guest and Accommodation Provider but is not the property manager and does not independently inspect or maintain the Accommodation.

8. Maintenance, Cleaning and Amenities
The Accommodation Provider is responsible for the cleaning, maintenance, operation, and condition of the Accommodation.

Guests must report any issue as soon as reasonably possible using the contact information provided by Come2Holiday or the Accommodation Provider.

The Accommodation Provider must be given a reasonable opportunity to investigate and address the issue.

Come2Holiday may assist with communication and attempt to help identify a suitable resolution. However, Come2Holiday cannot guarantee immediate repairs, replacement accommodations, access to amenities, or a specific refund.

Utilities, internet, pools, elevators, air-conditioning, resort facilities, and other amenities may occasionally be interrupted or unavailable due to maintenance, utility failures, weather, homeowner-association decisions, or circumstances outside Come2Holiday’s control.

9. Flights
Flights booked through Come2Holiday are selected, booked, and paid for on Come2Holiday.com.

The flight itself is operated by the relevant airline.

Airline-specific conditions apply to matters including:

  • baggage;
  • seating;
  • check-in;
  • identification;
  • schedule changes;
  • cancellations;
  • delays;
  • denied boarding;
  • refunds; and
  • rebooking.

The Guest or Customer is responsible for reviewing the applicable flight details and airline conditions before completing the Booking.

Come2Holiday may assist with flight-related communication or support, but operational decisions remain under the control of the relevant airline.

10. Travel Services and TripPilot
Come2Holiday may offer or arrange Travel Services including activities, airport transfers, transportation, concierge arrangements, restaurant assistance, and other destination services.

Unless expressly stated otherwise, these services are delivered by independent Travel Service Providers.

The applicable Supplier is responsible for the delivery, staffing, equipment, safety, licensing, scheduling, and quality of the Travel Service.

TripPilot may help Guests with destination information, recommendations, planning, and coordination.

TripPilot does not guarantee the availability of third-party services and does not replace official travel advice, emergency services, medical advice, or the Guest’s own judgment.

11. Passports, Visas and Travel Requirements
The Guest or Customer is responsible for obtaining and maintaining all documents required for travel, including:

  • passports;
  • visas;
  • travel authorizations;
  • identification;
  • vaccination records;
  • health documentation;
  • immigration forms; and
  • transit permissions.

Come2Holiday is not responsible if a Guest or Customer is denied boarding, entry, or transit because of missing, invalid, expired, or incorrect documentation.

Guests and Customers are responsible for reviewing applicable government and destination requirements before traveling.

12. Liability
Come2Holiday acts as a travel platform and booking facilitator between Guests or Customers and independent Suppliers.

To the extent permitted by law, Come2Holiday does not accept liability for loss, damage, injury, delay, inconvenience, or expense caused by:

  • an Accommodation Provider;
  • an airline;
  • a Travel Service Provider;
  • another third party;
  • inaccurate information supplied by a Supplier;
  • weather;
  • utility interruptions;
  • transportation delays;
  • government action;
  • homeowner-association decisions;
  • natural disasters; or
  • circumstances outside Come2Holiday’s reasonable control.

Come2Holiday is not responsible for the loss, theft, or damage of personal belongings during travel or while staying at an Accommodation.

Guests are strongly advised to obtain appropriate travel insurance.

Nothing in these Terms excludes liability that cannot legally be excluded.

13. Force Majeure
Come2Holiday is not responsible for a failure or delay caused by circumstances outside its reasonable control, including:

  • hurricanes;
  • severe weather;
  • natural disasters;
  • fire;
  • epidemic or pandemic;
  • war;
  • terrorism;
  • civil unrest;
  • strikes;
  • government restrictions;
  • border closures;
  • airline disruption;
  • utility failures;
  • cyberattacks; or
  • Supplier failure.

Any refund, credit, or rebooking in such circumstances will depend on the applicable Supplier policy, Booking conditions, and applicable law.

14. Complaints
Guests and Customers must report any issue as soon as reasonably possible.

Accommodation-related issues should be reported during the stay so that the Accommodation Provider has a reasonable opportunity to investigate and respond.

A complaint should include:

  • the Booking reference;
  • a clear description of the issue;
  • the date and time of the issue;
  • photographs or supporting evidence where relevant; and
  • the requested resolution.

Failure to report an issue promptly may limit the ability of Come2Holiday or the Supplier to investigate or provide a suitable remedy.

15. Entire Agreement
These Terms and Conditions, together with the Booking Confirmation, Supplier conditions, house rules, cancellation policy, payment conditions, and any Booking-specific agreement, form the complete agreement applicable to the Booking.

If a specific Supplier condition conflicts with these general Terms, the specific condition disclosed for the relevant Booking will apply to that Booking.

SECTION B: Cancellation and Refund Policy

1. Cancellation of an Accommodation Booking
An Accommodation Booking is considered confirmed when Come2Holiday sends a Booking Confirmation.

A Guest may cancel a Booking at any time by submitting a written cancellation request to Come2Holiday.

The cancellation policy applicable to the selected Accommodation will be displayed or communicated before payment and included in the Booking Confirmation.

The amount of any refund will depend on:

  • the specific cancellation policy accepted during booking;
  • the date and time the cancellation request is received;
  • the Accommodation Provider’s conditions;
  • non-refundable charges; and
  • any applicable processing fees.

Where the Booking includes the following standard cancellation policy, the cancellation fee is calculated on the accommodation rent amount as follows:

  • 0% cancellation fee for cancellations received within 48 hours after the Booking Confirmation, where the Booking is eligible for a grace period;
  • 20% cancellation fee for cancellations received more than 45 days before check-in;
  • 50% cancellation fee for cancellations received between 45 and 15 days before check-in; and
  • 100% cancellation fee for cancellations received less than 15 days before check-in.

A grace period does not apply where the Booking is identified as non-refundable or where different Supplier conditions were disclosed before payment.

2. Cancellation of Flights and Travel Services
Flight and Travel Service cancellations are subject to the conditions of the relevant airline or Supplier.

Some flights and Travel Services may be:

  • refundable;
  • partially refundable;
  • changeable for a fee; or
  • completely non-refundable.

Any applicable refund will be calculated according to the Supplier’s conditions, less any non-refundable fees or charges disclosed during booking.

3. Cancellations by Come2Holiday or a Supplier
Come2Holiday or the relevant Supplier may cancel a Booking where:

  • the Guest fails to make a required payment;
  • fraud or unauthorized payment is suspected;
  • the Guest provides materially incorrect information;
  • the Accommodation or Travel Service becomes unavailable;
  • the Supplier is unable to honor the Booking; or
  • circumstances outside reasonable control prevent delivery.

Where a confirmed Booking cannot be delivered, Come2Holiday may attempt to provide:

  • a suitable alternative;
  • a change of dates;
  • a travel credit; or
  • a refund for the affected part of the Booking.

Any alternative is subject to availability and Supplier approval.

4. Refund Processing
Approved refunds will normally be returned to the original payment method.

The time required for the refund to appear depends on the payment processor, card network, bank, airline, and Supplier.

Come2Holiday is not responsible for delays caused by third-party financial institutions after the refund has been correctly initiated.

Currency-conversion differences may cause the refunded amount to differ from the amount originally charged in the Guest’s or Customer’s local currency.

SECTION C: Delivery Policy

1. Accommodation Delivery
Come2Holiday will facilitate the confirmed reservation of the specific Accommodation stated in the Booking Confirmation.

The Accommodation Provider is responsible for making the Accommodation available at the confirmed location and travel dates and for delivering it in reasonable accordance with the listing description and photographs.

If the Accommodation Provider cannot deliver the confirmed Accommodation, Come2Holiday may assist with arranging a suitable alternative, credit, or refund, depending on availability, the circumstances, and the applicable Supplier conditions.

2. Flight Delivery
Come2Holiday will issue or facilitate the applicable flight confirmation after successful booking and payment.

The relevant airline is responsible for operating the flight in accordance with its own schedule and conditions.

3. Travel Service Delivery
Come2Holiday will facilitate the confirmed Travel Service stated in the Booking Confirmation.

The relevant Travel Service Provider is responsible for delivering the service at the agreed date, time, and location.

Where a Travel Service is not delivered as confirmed, Come2Holiday may assist the Guest or Customer in requesting a replacement service, credit, or refund from the relevant Supplier.
